How to Fight HOA Fines in Arizona
Arizona homeowners are protected by the Arizona Planned Communities Act (A.R.S. Title 33, Chapter 16) and the Condominium Act for condos.
Notice and Hearing Rights
Before an Arizona HOA can impose a monetary penalty, it must:
- Provide written notice of the violation
- Give you the right to request a hearing before the board (A.R.S. §33-1803)
- Follow the procedures in its own CC&Rs and rules
Step 1: Demand Written Notice
The notice must identify the specific provision violated and the proposed penalty. Vague notices ("your yard is unkempt") are vulnerable to challenge.
Step 2: Request a Hearing in Writing
You generally have the right to respond and be heard before the fine becomes final. Put your request in writing and keep proof of delivery.
Step 3: Check for Reasonableness and Selective Enforcement
Arizona courts expect HOAs to act reasonably and enforce rules uniformly. If neighbors were not cited for the same condition, raise selective enforcement.
Step 4: Send a Formal Dispute Letter
Cite A.R.S. §33-1803, identify any procedural failures, and request that the fine be dismissed.
