How to Appeal an HOA Architectural Violation

Architectural Review Committees (ARCs) wield significant power, but their decisions are not absolute.

Know the Standard

Most CC&Rs require the ARC to act reasonably and in good faith. Arbitrary or inconsistent denials can be challenged.

Step 1: Get the Decision in Writing

Demand a written explanation citing the specific standard your application failed to meet.

Step 2: Check the Timeline

Many governing documents impose a deadline (often 30–60 days) for the ARC to respond. If they missed it, your application may be deemed approved.

Step 3: Compare to Approved Projects

If similar modifications were approved for neighbors, cite them as precedent.

Step 4: Submit a Formal Appeal

Your appeal letter should reference the governing documents, the reasonableness standard, and any procedural failures.
